1.1 Stateside Microfinance Bank Limited is a financial banking institution in Nigeria, that is duly license by the Central Bank of Nigeria. You can get more information on our products and services at www.statesidebank.com.
1.2. At Stateside Microfinance Bank Limited (“the Bank” “We,” “Us,” and “Our”), we collect, handle and process personal data of our customers in the services we render. Consequently, we are committed to ensuring that the Personal Data of our customers are duly protected, accurate, confidential and secure, as well as strictly adhering to the provisions of the Nigerian Data Protection Regulation and all other extant laws on Data Protection.
1.3. Hence, we have developed this Privacy Policy to enlighten you on your privacy rights in relation to what data we collect, why we collect it, and what we do with it.
1.4. This Privacy Policy applies to all our customers/users (individually referred to as “You”) of our websites, applications, and other online platforms to which this Privacy Policy is posted (collectively, our “Services”).
2.0. CONSENT 2.1. This privacy policy between the Bank and you constitute our commitment to your privacy on all our services.
2.2. By accessing or using our services and providing your Personal Information to us, you expressly CONSENT to our collection, processing, storage, and disclosure of such information as described in this Privacy Policy.
2.3. However, if after you OPT-IN, you change your mind, you have the right to withdraw your consent for the continued collection and processing of your personal information in accordance with this policy, at any time, by contacting us. If you choose not to give us this personal information, it may delay or prevent us from fulfilling our contract with you or doing what we must do by law. It may also mean that we cannot run your accounts or policies. It could mean that we would cancel a product or service you have with us.
2.4. The provisions contained in this Privacy Policy supersedes all previous notices and statements regarding our privacy practices with respect to our Services.
WHAT DATA WE COLLECT:
Data You Provide Us: While using our products and services, we may ask you to provide us with certain data which are categorized under Personal Identifiable Information (PII) (as defined herein) that can be used to contact or identify you, such as name, address, passport details, identification numbers, Bank Verification Number (BVN), National Identification Number (NIN), biometric information, telephone number, photos uploaded, occupation, assets, income and any other information we deem necessary.
We will also request for the personal information of third parties such as your next of kin, guarantors, spouses, children, business partners or persons related to you or your business for reference purposes when you using any of our products and services that require such information.
The personal information we request/collect from you is needed to meet our legal or regulatory obligations and to provide you with the products or services requested by you.
We may also ask you to create login information to use any of our services, such as a username, Password and PIN.
4.2. Information About Your Transaction: We collect Personal Information about your personal financial statements (your account balance, payment records, and debit/credit card usage), interactions with relationship managers, your transactions with us when you use our digital platform to send and receive money, make purchases from merchants, pay bills, collect loans and deposit & withdraw cash, as well as other information associated with the transaction such as amount sent or received, amount paid for products or services, merchant information, including information about your device and geolocation.
We also collect Personal Data about the other participants associated with the transaction. We collect Personal Data such as names and financial account information about the participant who is receiving money from you or sending money to you.
4.3. Information from Third Parties: In some cases, we may also collect Personal Information about you indirectly from third parties including but not limited to: (i) third parties such as providers of ‘know your client’, anti-money laundering services which we use to help us meet our legal requirements in this area and to help us verify your identity where we provide you with products or services, and government agencies/regulatory bodies; (ii) background check providers which we sometimes use to verify your identity when you apply for a product of ours; (iii) third party service providers that help us to operate our website; and (iv) your banks, credit bureaus, payment gateways and other financial institutions. (v) family, solicitors, friends or employers, website/social media pages made public by you.
We may also collect other information such as video footages of you whenever you step into any of our branches, telephone conversations when you call any of our contact center lines, geographic information of any of our branch ATMs when you use our ATMs.
4.4. Information You Provide When You Apply for a Job with Us: When you apply for a job with us, we may request Personal Data about your education, employment, and state of health. We may also carry out screening checks (including reference, background and criminal record checks). We may exchange your Personal Data with academic institutions, recruiters, health maintenance organisations, law enforcement agencies, referees and your previous employers. By putting forward your application, you consent to the collection, processing, storage and disclosure of your personal data in accordance with the terms of this policy.
4.5. Information Collected by Cookies, and Other Technologies: Like most online services and mobile applications, we may use cookies and other technologies, such as web beacons, web storage, and unique advertising identifiers, to collect information about your activity, browser, and device. Cookies are computer files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Some of these data do not contain personal details about you or your business, but it is still protected by this Privacy notice. Other tracking technologies are also used such as beacons, tags and scripts to collect and track information and to improve and analyse our service. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some portions or all of our Service.
4.6. Derivative and Uploaded Data: When you access the App and launch some modules such as the loan module, you may be prompted to select two to three contacts in your contact list to be uploaded to our servers. Doing this enables us to provide you with loan credit worthiness and provide loan services or any other financial services to you. In addition, we may also request for access to your camera/photos and the microphone of your device (mic) to enable us upload your image or change the image on your KYC Profile and utilize our in-app call services when speaking to any of our representatives.
PLEASE NOTE that we will always seek your consent to access your Contact List, Camera/Photos and Microphone and also give you the option to opt- out or restrict our access in this regard. In the course of using the App, we will provide you with an affirmative user action to “tap to accept” or “tick a check box” to indicate your consent and explain why we need such access. When you restrict our access (withdraw your consent) we shall stop all access and also delete all your contact list from our server. On the other hand, the images you have voluntarily shared with us as part of your KYC Profile will remain on our server in line with our regulatory obligations and retention policy.
4.7. Information that we Automatically Collect: We (or our service providers acting on our behalf) may collect information about your use of our Services. This information may include Personal Information as well as statistical information that does not identify you (“Analytics”). Some Analytics may be correlated with Personal Information. When Analytics are, directly or indirectly, associated or combined with Personal Information, such Analytics will be considered Personal Information for purposes of this Privacy Policy.
We automatically collect log information when you use our services, such as:
- device information, such as your web browser type and language;
- Identification numbers associated with your Devices;
- Device identifiers;
- access times;
- pages viewed;
- The Device’s Internet Protocol (“IP”) address;
- identifiers associated with cookies or other technologies that may
- uniquely identify your device or browser;
- pages you visited before or after navigating to our website;
- Location preferences;
- Date and time stamps of transactions;
- System configuration information;
- Other interactions with our Services.
WHAT ARE YOUR RIGHTS
8.1. As a Data Subject, the privacy and processing of your personal information is protected under the Constitution of the Federal Republic of Nigeria 1999 (as amended) and the Nigerian Data Protection Regulation (NDPR). This policy has been designed to uphold your rights where we act as a data processor/controller.
8.2. You have the right to:
8.2.1. Know the information we keep about you in a common electronic format and/or request that such data be sent to a third party;
8.2.2. Withdraw your consent to processing and keeping your personal information;
8.2.3. Correct data that we hold about you that is inaccurate or incomplete;
8.2.4. Object to certain types of processing such as direct marketing;
8.2.5. Restrict the processing of your data;
8.2.6. Request for the data we hold about you to be erased from our record;
8.2.7. Lodge a complaint about how your personal data is being processed or handled; and
8.2.8. Request that your information be erased. We might continue to retain some data in order to comply with our legal and regulatory obligation and will provide you with such justifications upon request.
HOW WE SECURE YOUR INFORMATION:
9.1. As part of our commitment to delivering optimum service to our customers, we take adequate security measures to maintain your data in a secure and organized manner. Only authorized employees from our organization can access, alter, disclose and destroy personal data, when required.
9.2. We have put in place a state of the art physical and technical security measure to protect against unauthorized access, alteration, disclosure of personal information, username, password, transaction information and data stored in your user account. Such measures include but are not limited to protecting systems from hackers, setting up firewalls, storing data securely with access to specific authorized individuals, employing data encryption technologies, developing organizational policy for handling Personal Data (and other sensitive or confidential data), protection of emailing systems and continuous capacity building for staff.
9.3. Access to your Personal Information is restricted to our employees/professional advisors who need to process such information in connection with delivering our services to you and are bound by legal confidential obligations. Our employees and professional advisors only act within the scope of their authority and are trained to prevent any errors or omissions.
9.4. We also carry out consistent security monitoring exercises to ensure that our systems are updated and adopt appropriate industry data collection, storage, and processing practices.
9.5. While we will ensure that your Personal Data is securely stored, bear in mind that no method of transmission over the internet or method of electronic storage is 100% secure and we cannot guarantee its absolute security.
9.6. In addition, you are responsible for securing and maintaining the privacy of your Personal Data and you must not share them with third parties. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
